There is no private conversation left in this world. You can’t talk to your spouse, you can’t talk to your co-worker, you can’t talk to your childhood friend without that privacy being broken. Yes even your spouse. Any time there is a dispute between two spouses there is a door swinging open to the privacy of a relationship you once thought you had. But you didn’t. That conversation about that thing you did, yeah she told everyone. That time you and your friend jumped the fence at that party – it’s on social media. YOU CAN’T BUY PRIVACY …
But you can rent it – in a different kind of way. Speaking to an attorney as a current client or in anticipation of retaining the services of an attorney, could GIVE YOU PRIVACEY. The ability to have a PRIVATE conversation with a professional about the legal issues you are currently having, questions about conduct you committed in the past or an analysis of other legal matters.
A PRIVATE space gives a person the ability to speak with almost no limits other than through the guidance of the attorney. The attorney will assure that you are well within your ethical and legal bounds to be able to speak your truth and not have it held against you.
You must keep in min that there are ways to break the attorney / client privilege:
Many times person want to include there family member or friend in a conversation they have with an attorney. While this is emotionally helpful to create a comfortable setting, you are in fact destroying the ability for a conversation to be absolutely private. It dos not matter how much you trust that individual – brining in a a third party to the conversation will invalidate any claim at a later time that the contents of that conversation were private.
Another way to break this privilege is to record the conversation. In order for this conversation to remain private the conversation and its parties must all consent to the contents of the conversation and a secret recording where only one party knows of the conversation also invalidates the conversation with your attorney as being private.
It is best to speak to your attorney on a secured phone line or in the office. The key to your privacy is understanding that your EXPECTATION OF PRIVACY is what has to be secured by you and by your attorney.
We don’t have many privileges left in life – but your private conversation with your attorney is one right that has still been reserved by the People.
